A businessman employed by the GAP was accused of his second DWI when a police officer attempted to pull him over for speeding and running a stop sign. The officer followed him with his lights and sirens on as my client took a very long time to pull over, eventually parking in front of his house. After being removed from his truck, he failed the Walking Test, One Leg Stand Test, and the Eye Test. The officer testified that my client had a strong odor of alcohol on his breath and had slurred speech. When asked if he was drunk, my client said “yes.” This all was recorded on mobile videotape. His verdict was returned Not Guilty!
